Privacy Policy

pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree 196/2003 as amended by Legislative Decree 101/2018

2. Categories of Data Collected

The site collects personal data in the following cases:

2.1 Contact form

When the user fills in and submits the contact form on the /contact page, the following data is collected:

  • First and last name (mandatory);
  • Email address (mandatory);
  • Phone number (optional);
  • Body of the message (mandatory);
  • Confirmation of acceptance of this privacy policy (mandatory).

Purpose: to respond to the user's requests, manage pre-contractual relations and provide information about the vehicles or services offered.
Legal basis: performance of pre-contractual measures at the request of the data subject (Art. 6(1)(b) GDPR) and explicit consent given by ticking the box accepting this policy (Art. 6(1)(a) GDPR).
Provision of the data: optional. However, failure to provide the data marked as mandatory prevents the request from being submitted.

2.2 Browsing data (system logs)

For operational, security and diagnostic purposes, the hosting provider may automatically record some technical browsing data, including:

  • visitor IP address;
  • browser type and operating system;
  • date and time of the request;
  • page visited and referer;
  • technical identifiers for abuse prevention.

Such data is processed solely by the hosting provider for technical and security purposes and is not used by the Data Controller for profiling or identification of individual visitors.

3. Legal Basis for Processing

  • Contact form: performance of pre-contractual measures (Art. 6(1)(b) GDPR) and explicit consent (Art. 6(1)(a) GDPR).
  • Technical browsing data: legitimate interest of the Data Controller in the proper functioning and security of the site (Art. 6(1)(f) GDPR).

4. Method of Processing

Data is processed using automated tools for the time strictly necessary to achieve the purposes for which it was collected. No profiling activities or automated decision-making within the meaning of Article 22 GDPR is carried out.

Data collected via the contact form is transmitted and processed via the following technical providers, designated as Data Processors pursuant to Article 28 GDPR:

  • Cloudflare, Inc. (United States) - hosting of the site and execution of the Cloudflare Pages Functions that receive and process the form submission;
  • Resend (Bedrock Software, Inc.) (United States) - transactional email service used to forward the form's message to the Data Controller's email address;
  • Supabase, Inc. (United States) - database and storage service used exclusively for managing the site's vehicle catalogue (it does not receive contact form data).

5. Place of Processing

Data is processed at the technical infrastructure of the providers listed above, located both within the European Union and in the United States.

6. Retention Period

  • Contact form data: retained for the time needed to handle the request and subsequently for a maximum of 24 months for administrative documentation purposes, unless the data subject requests earlier deletion.
  • Web server system logs: retained for the period strictly necessary for technical and security purposes, in accordance with the hosting provider's policies (generally no longer than 30 days).

7. Disclosure and Dissemination of Data

Personal data collected is not disseminated nor disclosed to third parties for marketing or profiling purposes. Disclosure to the technical providers listed above takes place exclusively for the technical purposes of operating the site and managing requests, on the basis of specific Data Processing Agreements pursuant to Article 28 GDPR.

8. Resources Loaded from Third Parties

For the operation of the vehicle detail pages, the site loads a JavaScript library from the esm.sh CDN to initialise the connection to the Supabase service for reading catalogue data. This request is limited to the duration of a single browsing session, does not install profiling cookies and does not entail user tracking by esm.sh.

9. Transfer of Data Outside the EU

Some of the technical providers used (Cloudflare, Inc., Resend / Bedrock Software, Inc. and Supabase, Inc.) are based in the United States. The transfer of personal data outside the European Economic Area takes place on the basis of the Standard Contractual Clauses approved by the European Commission (Decision 2021/914) and, where applicable, the EU-US Data Privacy Framework, ensuring an adequate level of protection in accordance with Articles 44-49 GDPR.

10. Rights of the Data Subject

Pursuant to Articles 15-22 GDPR, the data subject has the right to:

  • Access (Art. 15): obtain confirmation of the existence of personal data concerning them and its disclosure;
  • Rectification (Art. 16): obtain the correction of inaccurate data or the integration of incomplete data;
  • Erasure (Art. 17): obtain the erasure of data, in the cases provided for by the regulation;
  • Restriction (Art. 18): obtain the restriction of processing;
  • Portability (Art. 20): receive the data in a structured, commonly used and machine-readable format;
  • Objection (Art. 21): object to the processing for reasons related to their particular situation;
  • Withdrawal of consent (Art. 7(3)): withdraw consent at any time, without affecting the lawfulness of processing based on consent given before the withdrawal.

These Terms and Conditions of Use (hereinafter "Terms") govern access to and use of the website https://www.mbm-power.com/ (hereinafter the "Site"), owned and operated by MB M-Power S.R.L.. Access to and navigation of the Site implies full acceptance of these Terms.

3. Purpose

The Site is informative and illustrative of the activity, services and contact details of MB Mpower. The vehicle catalogue published on the Site is intended to present the offering and does not constitute an offer to the public nor a solicitation to purchase within the meaning of Article 1336 of the Italian Civil Code. Vehicle information, including prices and availability, may be modified at any time without notice and must be confirmed by the Owner at the time of any negotiation.

4. Contact Form

The contact form available on the Site allows the user to send requests for information to the Owner. Submitting a request via the form does not constitute a contract or commitment of either party, but only an expression of interest to which the Owner will respond at the time and by the means it deems most appropriate. The processing of personal data entered in the form is governed by the Privacy Policy.

5. Intellectual Property

All content on the Site - including but not limited to texts, images, graphics, logos, icons, trademarks, trade names and layout - is the property of MB M-Power S.R.L. or is used with the authorisation of the respective rights holders, and is protected by Italian and international copyright law (Law of 22 April 1941, no. 633 as amended) and industrial property law (Italian Legislative Decree 30 of 10 February 2005).

Any reproduction, distribution, modification, transmission or use of the Site's content, in whole or in part, is prohibited without the prior written consent of the Owner.

6. Limitation of Liability

The information contained on the Site is provided "as is" and is intended for informational purposes only. MB M-Power S.R.L. undertakes to keep the information up to date and accurate, but does not guarantee the completeness, accuracy, reliability or suitability of such information for particular purposes.

In no event shall MB M-Power S.R.L. be liable for direct, indirect, incidental, consequential or any other damages arising from access to the Site, the inability to access it, or the use of the information contained therein.

The Site may contain hyperlinks to third-party websites (for example social platforms, messaging apps, maps). Such links are provided solely for the user's convenience. MB M-Power S.R.L. exercises no control over third-party sites and is not responsible for their content, privacy policies or practices. Access to third-party sites is entirely at the user's own risk.

MB M-Power S.R.L. endeavours to ensure continuous access to the Site, but does not guarantee that the Site will be available in an uninterrupted, timely, secure or error-free manner. The Owner reserves the right to suspend, modify or discontinue the Site, in whole or in part, at any time and without notice.

9. Changes to the Terms

MB M-Power S.R.L. reserves the right to modify these Terms at any time. Changes shall be effective from the moment they are published on the Site. Continued use of the Site after the publication of changes constitutes acceptance of them.

10. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any dispute arising from the interpretation, execution or breach of these Terms shall be subject to the exclusive jurisdiction of the Court of Corciano, except where the user qualifies as a consumer within the meaning of Italian Legislative Decree 206/2005, in which case the jurisdiction of the place of residence or domicile of the consumer shall apply, where located in Italy.
